Your journey is subject to the Booking Conditions you accept when you make your reservation. If you are rebooking a trip using a credit voucher, you must accept the most recent version of the Booking Conditions that apply at the time of rebooking.

If you are making a reservation from the United Kingdom or Europe, please refer to the Booking Conditions applicable to these territories.

Before reserving a trip with us, please take the time to read and comprehend the terms and conditions listed below. We also urge that you read the Essential Trip Information and Important Notes pertaining to your trip prior to booking to ensure that you are aware of the schedule, style, and physical requirements of the trip you will be taking. Our website contains the Essential Trip Information and Important Notes pertinent to your Trip.

Please review the Special Conditions for additional terms that may apply to each of your trips.

International Terms & Conditions for Reservations

1. Our contract
All bookings are made with your local Asia Travel Mates business, as described in paragraph 26, which acts as an agent for Asia Travel Mates Corp. (us/we). By booking a tour/trip with us, you agree to be bound by the terms and conditions set out in: these Booking Conditions; the Essential Trip Information that applies to your trip; and any Special Conditions that may apply, as well as any other terms and conditions that may be applicable (which constitutes the entire agreement between you and us).
Your reservation will be accepted on these terms. Those services listed on your booking confirmation invoice will be supplied.

2. Privacy policy
Any personal information we gather will be treated in accordance with our Privacy Policy and may be used for any reason related to the operation of a trip. By making this reservation, you consent to this information being shared with the relevant parties, such as our agents, service providers, and other suppliers, in order for us to operate the trip or, if permitted by any applicable Spam laws, to send you marketing material regarding our events and special offers.

You are responsible for frequently reading this Privacy Statement and staying informed of any modifications.

3. Deposit required
In order to confirm your reservation, you must pay a non-refundable deposit. The needed deposit for our tours/trips in Indochina ( Vietnam, Laos, and Cambodia ) is USD20 per person, per trip. Unless otherwise specified in the Special Conditions, a deposit of USD 50 per person per trip is needed for all other journeys. When a reservation is made within 56 days of departure, the entire price is due at the time of booking.
Deposit amounts vary for some excursions and special campaigns that we may conduct from time to time, as outlined in the Special Conditions and subject to their terms.

Acceptance of the reservation and final payment
If we accept your reservation, we will send you a confirmation invoice. A contract will exist between us and you on the day that we provide the confirmation invoice, or if you book within 56 days of departure when we receive your payment. Please refer to your booking confirmation invoice for information on final payments, including payment instructions. The rest of the trip price is payable 56 days before to departure unless otherwise specified in the Special Conditions. If this amount is not paid by the due date, we retain the right to terminate your reservation and impose any cancellation fees stated in section 7 (Cancellation by You).

5. Costs and additional fees
Our trip costs are subject to seasonal and changeable pricing, both of which are common in the travel business. This implies that our trip rates are subject to change at any time based on demand, market circumstances, and availability. There is a possibility that different customers on the same flight were charged different fares. If you like the pricing, your best choice is to book at that time. Any price reductions or discounts that become available after your deposit has been paid will not apply. If you choose to cancel your reservation to take advantage of a lower rate, the full cancellation terms outlined in paragraph 7 apply (Cancellation by You). The most recent price information is accessible on our website. Costs are based on currency conversion rates as of June 2021; prices may vary according on the currency in which the reservation is made. We retain the right to apply surcharges up to 56 days prior to departure owing to unfavorable changes in exchange rates, increases in airfares or other transportation expenses, increases in local operator fees, taxes, or if required by government action. In such cases, we will cover up to 2 percent of the total travel cost, and you will be liable for the remainder. If a fee increases the cost of your trip by more than 10 percent, you may cancel your reservation and get a full refund within 14 days of being notified of the surcharge. Please be aware that a fee may be imposed to credit card purchases.

6. Your details
For us to finalize your travel reservations, you must give the remaining balance together with all needed information. Included but not limited to are your entire name as it appears on your passport, date of birth, nationality, passport number, passport issue and expiration dates, and any pre-existing medical issues that may impair your ability to fulfill your travel plans. Your sales agent will supply you with a Self-Assessment form for some excursions that are more strenuous and need you to complete and submit it. Please refer to our Privacy Policy for more details on how we handle your personal information.

7. Revocation by you
If you cancel any or all of your reservation, the following cancellation rules will apply. A cancellation will not take effect until we get the written confirmation that you gave to your sales representative. If you cancel a trip:
(a) 56 days or more prior to departure, we will hold your deposit as a credit; (b) between 31 and 55 days prior to departure, we charge a cancellation fee of 30% of the total booking cost; (c) between 30 and 15 days prior to departure, we charge a cancellation fee of 60% of the total booking cost; and (d) 14 days or fewer prior to departure, we charge a cancellation fee of 100% of the booking cost.

Note that various cancellation policies apply to certain types of tours and extra services, as outlined in the Special Conditions and Essential Trip Information pertaining to your trip. It is strongly recommended that you get cancellation insurance at the time of booking. If you abandon a trip after it has begun for whatever reason, we are not required to issue reimbursements for unused services. No refunds will be issued if you fail to join a tour, join it after its departure, or leave before its conclusion. The aforementioned cancellation limitations are in addition to any costs that may be assessed by lodging providers, travel brokers, or third-party tour and transit operators. Please refer to clause 19 (Liability) for further information on your rights under the Australian Consumer Law that may apply to your cancellation.

8. Annulment by us
In the event that we cancel your trip, you may transfer payments to alternative departure date or obtain a refund, unless the cancellation is due to a Force Majeure Event (as defined in this article). 8. \s8.1 Cancellation due to Force Majeure
If a trip is canceled owing to a Force Majeure Event, you have the option of receiving either: (a) a credit for the full amount paid for the trip; or (b) a refund less any unrecoverable costs.
If cancellation due to a Force Majeure Event happens after a trip has begun, we can provide you a pro-rated: (a) 100 percent credit for the remaining days of your trip; or (b) reimbursement minus unrecoverable costs for the remaining days of your trip.
A “Force Majeure Event” includes, but is not limited to, the following: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or another health emergency; flood; windstorm or another extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition, or requirement or any other act of any government
In the case of a cancellation, neither party may assert a claim for damages, and we are not liable for any incidental charges you may have incurred as a result of your booking, including but not limited to visas, vaccines, travel insurance excess, or non-refundable flights.

Important Credit Notification:
There may be instances in which we extend credit to you. For instance, if you are eligible for a full or partial refund, we may provide you with a credit voucher instead of a cash refund. Unless otherwise provided in the Special Conditions, credits are granted in accordance with these Booking Conditions:

has no expiration date, may be used to any other available trip we provide, cannot be transferred to another person or redeemed for cash, and cannot be used to buy flights or insurance since they have their own booking terms.

9. Booking modifications
Transfers to a third party or an alternate trip are only authorized if operationally feasible and, in the event of a transfer to a third party, if the transferee satisfies all trip conditions. Some fees may apply.
Your reservation cannot be modified within 56 days of departure.

10. Comprises
The total price of your trip includes the services of a group leader, as outlined in the Essential Trip Information, as well as all lodging, transportation, and meals.
11. Exclusions
The land price of your trip does not include international or domestic flights unless specified, airport transfers, taxes, and excess baggage charges, unless specified, meals other than those specified in the Essential Trip Information Visa and passport fees optional activities travel insurance, and all personal expenses.
Age and health prerequisites
Minimum Age:
At the time of travel, the minimum age for the majority of our tours is 15. All passengers under the age of 18 must be accompanied by a legal guardian or, in place of a legal guardian, an escort older than 18 who has been chosen by the legal guardian. The legal guardian or their designee will be responsible for the daily care of the traveler under the age of 18. If a legal guardian chooses to appoint an escort in their place, they will be asked to sign a paper delegating their power.

Maximum Age: For the bulk of our tours, there is no maximum age restriction; however, our tours can be physically demanding, so guests must ensure they are physically well enough to participate fully. We can give information on necessary health needs, but we are not medical professionals. You are responsible for obtaining competent and comprehensive medical advice at least two months before departure on the most recent health needs and recommendations for your trip.

Additional conditions
Please see the Special Conditions for additional terms that apply to particular excursions.
Due to the nature of some of our excursions, you may be required to sign and submit a separate waiver, additional conditions, and/or a release form to a third-party supplier that is assisting in the operation of your trip, in addition to these Booking Conditions. Specifically, the ground suppliers of our North American tours need that you sign a release on the first day of your trip in order to satisfy their insurance requirements. On request, a copy of this waiver can be sent to you prior to departure.
In the event of any inconsistency between these Booking Conditions and the additional waiver, these Booking Conditions shall prevail and override the supplemental waiver. We have the right to reject your participation if a waiver has not been signed.

14. Passport and visa requirements
You are responsible for obtaining information and possessing all papers and identification necessary for entrance, exit, and travel in any nation or territory you visit during your trip. This includes a valid passport and any travel documentation necessary by us and/or the applicable governmental agencies, such as visas, permits, certifications (such as immunization or medical certificates), and insurance plans. Your passport must be valid for six months beyond the latest date of travel on your itinerary. You assume complete responsibility for acquiring all such paperwork, visas, and permissions prior to the commencement of the excursions, and you are entirely liable for the whole amount of fees spent due to missing or faulty documentation. You agree to be liable for the entire amount of any damage or expenditure incurred by us as a direct result of your inability to procure or possess suitable travel paperwork.

15. Travel insurance

All of our travelers are required to get travel insurance at the time of booking. Your travel insurance must give coverage against personal injury, death, medical bills, and emergency repatriation, with a minimum coverage of US$200,000 suggested for each category of protection. We also recommend that it includes coverage for trip cancellation, curtailment, personal responsibility, and loss of baggage and personal possessions. You must supply your travel insurance policy number and the 24-hour emergency contact number of your insurance company on the first day of your trip; without these data, you will not be permitted to join the trip. If you have travel insurance tied to your credit card or bank account, ensure that you have the participating insurer’s information, the insurance policy number, and an emergency contact number rather than the bank’s name and credit card information.

Change of travel plans

You understand and accept that the nature of this sort of journey necessitates a great deal of adaptability and that you must account for alternatives. It is acknowledged that the route, timetables, itineraries, facilities, and method of transportation may be subject to change owing to local conditions or occurrences.

While we make every effort to conduct tours as stated, we retain the right to alter itineraries. Please check our website prior to departure for the most updated itinerary revisions.

If there is time before departure and we make a significant modification, we will tell you as soon as is practicable. A big alteration is defined as one that affects at least one out of every five days of the itinerary. When a significant modification is made, you have the option of accepting the adjustment, requesting a refund for the land-only component of the trip, or accepting an alternate vacation.

After departure: We retain the right to alter the route due to local conditions or a Force Majeure event. In such an emergency, you will be responsible for any additional costs associated with itinerary adjustments.

Please note that we are not liable for any additional costs incurred as a consequence of itinerary changes, including but not limited to visas, vaccines, and non-refundable or non-changeable flights.

17. Expert on tour
Our excursions are directed by a group leader. The group leader’s judgment is final on any topics that might impact the safety or well-being of any traveler or staff member on the trip. If you fail to comply with a group leader’s decision or impede the safety or mobility of the group, the group leader may instruct you to leave the trip immediately without a refund. We may also choose not to transport you on any future journeys. You must adhere at all times to the laws, customs, foreign exchange, and drug rules of all countries visited, and you agree to adhere to our Responsible Travel Guidelines.

18. Risk acceptance

You agree that the nature of the trip may be risky and that participation entails some personal risk. You may be traveling to locations where the political, cultural, and geographical characteristics provide more hazards and physical hurdles than in our daily life.

You agree that you are voluntarily deciding to travel during a period when you may be exposed to the COVID-19 virus. We will take every precaution to protect your safety, and you may be required to adhere to additional safety standards throughout your journey.

We utilize information from government foreign affairs agencies and feedback from our own connections to determine whether or not the itinerary should be implemented. You are responsible for familiarizing yourself with any pertinent travel information, including applicable health risks and the nature of your trip. You agree that your choice to travel is based on this information and that you are aware of the hazards associated with such travel. To the maximum degree permissible by law, we assume no responsibility for these extra risks.

19. Responsibility and service assurance

Our services, including our tours (the “Services”), may be accompanied by warranties that cannot be excluded under Australian Consumer Law.

The unified consumer protection law laid out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the CCA).

19.1 We exclude, to the maximum extent permitted by law (including the CCA), all liability to you or any other person (whether in contract tort or otherwise) for any loss (whether direct, indirect, consequential) including death or personal injury or damage of any kind that may be suffered as a result of any act or omission whether negligent or otherwise by or on behalf of us in connection with the Services or any other matter or thing relating to these Booking Conditions. This provision neither restricts nor excludes your rights under the CCA.

19.2 (Limitation of Liability) Where the law implies a guarantee into these Booking Conditions that cannot be legitimately excluded (such as warranties under the CCA), our responsibility for violation of such a warranty is limited to re-supplying the Services or paying the cost of having the Services re-supplied.

19.3 (Indemnification) You agree to indemnify us (and all of our subsidiaries, officers, employees, contractors, and agents) against all losses, claims, actions, processes, damages, costs and expenses (including legal fees) resulting directly or indirectly from or in connection with:

(a) your access or use of the Services, including the access or use of your delegate; and

(b) any violation by you (or your representative) of:

I these Terms and Conditions or

(ii) any other terms relevant to the provision of the Services,

unless such loss or harm is a direct result of our fraud or intentional misbehavior.

19.4 (Third parties) As agents for these third parties, we engage with a network of companies, activity providers, lodging providers, airlines, coach and transfer companies, tour and local guides, government agencies, independent contractors, and individuals to help in the operation of our excursions (Third Party Supplier). Additionally, Third Party Suppliers may use local operators and subcontractors. Despite taking all reasonable measures to choose trustworthy Third Party Suppliers, we cannot be held liable for their actions or omissions. Any services provided by Third Party Suppliers may be subject to their terms and conditions, and you may be asked to sign additional terms as outlined in section 13. These may restrict or exclude the Third Party Supplier’s obligation. You accept that Third Party Suppliers comply with the laws of the countries in which they operate and that we do not warrant that any Third Party Supplier complies with the laws of your place of residence or any other jurisdiction.

These Third Party Suppliers’ actions and omissions, whether negligent or otherwise, are not our responsibility. Any disagreements between you and a third party must be addressed completely between you and that third party.

19.5 (Vicarious Liability) We shall not be held vicariously responsible for the deliberate or negligent conduct of non-workers, nor for the intentional or negligent acts of our employees performed off-duty or beyond the scope of their employment.

20. Optional pursuits

Activities that are not included in the trip fee are not a part of the trip or this agreement. You acknowledge that any help, recommendations, or advice offered by your group leader or local representative in organizing optional activities (including before and after a trip) does not in any way obligate us to assume responsibility for them. You and the activity provider will enter into the contract for the supply of this activity.

21. Claims & complaints

Please tell your group leader or our local agent immediately if you have a problem about your trip, so that they can endeavor to resolve the issue. If you think that your issue has not been handled through these channels, please submit any additional complaints via our General Enquiries page within 30 days after the conclusion of your trip.

22. Adverseness

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law, as being contrary to public policy, or for any other reason, then such term or condition shall be deemed severed from this contract or amended accordingly only to the extent required to allow all remaining terms and conditions to survive and continue as binding.

23. Law applicable

Victoria, Australia law governs these Booking Conditions to the maximum degree permitted. These Booking Conditions, including this section 23, do not affect your rights as a consumer to depend on local laws.

24. Assignment and Address of Record

At our sole discretion, we may assign or otherwise transfer any of our rights or obligations under these Booking Conditions, including novation to a connected body corporate (as defined by the Corporations Act 2001 (Cth)), by written notice to You (including notice via the Website).

25. Booking entity
Depending on the area or region from where you are booking, the following Intrepid company will operate as an agent on behalf of Asia Travel Mates Corp.
Reservations for the rest of the world are made directly with Asia Travel Mates Corp.
If you are booking through a third-party travel agent, Asia Travel Mates Corp is the relevant business

26. Promotional conditions
We may conduct promotions and special offers (Promotions) on our website from time to time, which are subject to both these Booking Conditions and any additional promotion-specific conditions that are incorporated by reference into these Booking Conditions. You should be sure to read the Promotion’s unique terms and restrictions.

Promotions are only available for the duration specified on our website. We have the right to cancel or alter any Promotion at our sole discretion and at any time. By purchasing a trip on a promotional basis, you agree to and accept the applicable Promotion rules. In the case that these Booking Conditions and the Promotional conditions are inconsistent, the Promotional terms shall govern your booking.
