Important Notice: By creating an account, making a booking, or using our Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and any other rules or guidelines posted on the platform.

Chapter 1. General Provisions

Article 1 (Purpose and Scope)

These Terms govern all use of the Asia Travel Mates Service. They apply to all reservations, transactions, communications, and any other interactions between Guests and Our Company. The latest version of the Terms, as published on our platform, will always prevail. We provide translations of these Terms in various languages for your convenience; however, in the event of any discrepancy, the Japanese version shall be the legally controlling version. Any specific rules, guidelines, or policies posted for particular services or regions form an integral part of these Terms.

Article 2 (Definitions)

For the purpose of these Terms, the following terms shall have the meanings ascribed to them below:

  • “Asia Travel Mates Service” or “Platform”: The online marketplace and related services operated by Our Company, which enables users to search, compare, book, and purchase various travel-related products and services offered by third-party providers.
  • “Host”: Any independent third-party business entity (e.g., tour operator, hotel, activity provider, transportation company) that lists and provides Travel-Related Services through our Platform.
  • “Host Service”: Any travel-related product, service, or experience (e.g., guided tours, accommodation bookings, activity tickets, transportation passes) that is offered by a Host and can be booked through our Platform.
  • “Guest”: Any individual or entity that registers an account and/or books a Host Service through the Platform.
  • “Additional Users”: Individuals, such as family members or companions, for whom a Guest makes a booking or who are added to a reservation. The Guest is solely responsible for the actions and compliance of all Additional Users with these Terms.

Article 3 (Handling of Personal Information)

Our Company is committed to protecting your privacy. The collection, use, storage, and disclosure of your personal information are governed by our Privacy Policy. Our use of cookies and similar tracking technologies to enhance your experience and analyze service usage is detailed in our Cookie Policy. By agreeing to these Terms, you consent to the data practices described in these documents.

Chapter 2. Using the Asia Travel Mates Service

Article 4 (Account Registration and Security)

To access most features of the Service, you must register for a personal account (“Account”). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are solely responsible for safeguarding your Account password and for any activities or actions under your Account. You must notify us immediately of any unauthorized use of your Account. We reserve the right to refuse service, suspend, or terminate accounts at our sole discretion, particularly in cases of suspected fraud, provision of false information, or violation of these Terms.

Article 5 (Modifying Account Information)

You may review, update, or correct your account information at any time by logging into your Account settings. It is your responsibility to ensure your contact information, especially your email address, is always current so you do not miss critical communications about your bookings.

Article 6 (Nature of the Asia Travel Mates Service)

Our Company operates an online platform that connects Guests with Hosts. We are not a traditional travel agency nor the direct provider of the Host Services. We act as an intermediary and are not a party to the contract ultimately formed between you and the Host. Consequently, we do not guarantee, endorse, or assume liability for the quality, safety, legality, or accuracy of the listings, descriptions, or services provided by Hosts. All Host Services are the sole responsibility of the independent Host who provides them.

Article 7 (Delivery of Important Information)

All official communications, including booking confirmations, receipts, itineraries, vouchers, and important updates or changes to your Host Service, will be delivered to you electronically via the messaging system on the Asia Travel Mates Platform and/or the email address associated with your Account. You are responsible for reading these messages promptly.

Article 8 (Passports, Visas, and Insurance)

  • Travel Documents: You are solely responsible for obtaining and maintaining a valid passport, any required visas, vaccinations, and complying with all entry, health, and other requirements of your destination country. Our Company provides general information for reference only and accepts no liability for denied entry or delays.
  • Travel Insurance: We strongly recommend that all Guests purchase comprehensive travel insurance for their trip. This insurance should cover unforeseen circumstances such as trip cancellation, interruption, medical emergencies, evacuation, loss of baggage, and personal liability. Our Company is not responsible for any losses incurred due to your failure to obtain adequate insurance.

Chapter 3. Use of Host Services

Article 9 (Conclusion of Contract)

A contract for a Host Service is formed directly between you and the Host when you complete the booking process and receive a confirmation from us. Our role is limited to facilitating the transaction and transmitting relevant details to the Host. It is your duty to ensure you and any Additional Users meet all eligibility requirements (e.g., age, health, skill level) specified by the Host for the service.

Article 10 (Changing a Booking)

Any request to modify an existing booking (e.g., change of date, number of participants) is subject to the Host’s approval and the specific terms of the Host Service. Changes are not guaranteed. If a change is possible, you may be subject to additional fees charged by the Host and/or a processing fee from Our Company.

Article 11 (Cancelling a Booking)

Cancellations must be made through the Platform according to the specific cancellation policy set by the Host for the service you booked. Please review this policy carefully before confirming your reservation. Cancellation fees will be applied based on the timing of your cancellation and the Host’s policy. In some cases, cancellations may result in a full forfeiture of the amount paid.

Article 12 (Termination for Causes Attributable to Our Company)

If a confirmed Host Service cannot be provided due to a fault solely attributable to Our Company’s platform or facilitation services (e.g., a critical technical error on our part that prevents the booking from reaching the Host), you may be entitled to terminate the contract. In such a rare event, our liability will be limited to a full refund of the fees paid to us for that service.

Chapter 4. Use of Arranged Travel Services

Article 13 (Scope of Arranged Services)

For certain comprehensive travel packages that we help arrange (e.g., multi-day tours with integrated flights and hotels), we may act in a more formal capacity. These “Arranged Travel Services” involve Our Company making reservations for transportation, accommodation, and other services on your behalf as an agent.

Article 14 (Changes and Cancellations)

Requests for changes or cancellations to Arranged Travel Services must be submitted to us. Such requests are subject to the terms and conditions of the individual service providers (airlines, hotels, etc.) and may incur significant fees, which you agree to pay. The ability to make changes is not guaranteed.

Chapter 5. Planned Tours

Article 16 (Company-Planned Tours)

For tours explicitly designed, planned, and implemented by Our Company (“Planned Tours”), we will provide a separate detailed itinerary and contract that outlines the specific inclusions, exclusions, and terms. These Planned Tours are subject to their own specific terms and conditions, which will be provided at the time of booking and will supersede any conflicting general terms here.

Chapter 6. Settlement

Article 19 (Payment Terms)

You agree to pay all fees and charges associated with your bookings in accordance with the payment methods we designate (e.g., credit card, PayPal). All prices are final and quoted in the currency displayed. You represent and warrant that you have the legal right to use any payment method you provide. For credit card payments, the card must be under the name of the Guest making the booking. You authorize us to charge your payment method for the total amount due, including any applicable taxes and fees.

Chapter 7. Precautions When Using The Service

Article 28 (Prohibited Activities)

When using the Service, you agree not to:

  • Violate any applicable law, regulation, or third-party rights.
  • Use the Service for any commercial or fraudulent purpose.
  • Post false, inaccurate, misleading, or defamatory content.
  • Harass, discriminate against, or harm other users or Hosts.
  • Attempt to circumvent our payment systems or booking processes.
  • Copy, scrape, or spider any part of the Platform without our express permission.
  • Interfere with or damage the operation of the Service or any user’s enjoyment of it.

Article 31 (Disclaimer of Warranties)

THE ASIA TRAVEL MATES SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR COMPANY EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE QUALITY OF ANY HOST SERVICES WILL MEET YOUR EXPECTATIONS.

Chapter 8. Miscellaneous Provisions

Article 34 (Amendment of Terms)

Our Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the “Revised on” date. It is your responsibility to review the Terms periodically. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

Article 35 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Tokyo, Japan.

Guest Review Terms of Use

Article 1 (Purpose)

These Review Terms govern your use of the review, rating, and related features (“Review Function”) on the Asia Travel Mates Platform. Your use of the Review Function constitutes agreement to these terms.

Article 4 (Content Guidelines and Prohibitions)

To maintain the integrity of our review system, you agree that your reviews will be truthful, unbiased, and based on firsthand experience. You are prohibited from posting content that:

  • Is defamatory, obscene, pornographic, offensive, or promotes discrimination.
  • Contains private or confidential information of others.
  • Is written for the purpose of extortion or to manipulate a Host’s rating.
  • Is posted by a competitor with the intent to harm a Host’s reputation.
  • Violates any applicable law.

Article 9 (Modification)

We may amend these Review Terms from time to time. The amended Review Terms will be effective upon posting and will be governed by the amendment provisions set forth in the main Guest Terms and Conditions.
